1. Agreement to Terms

By downloading, installing, or using the ApexDrive mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). The App is operated by Shivonix Technologies (OPC) Private Limited ("Company," "we," "us," or "our").

2. Description of Service

ApexDrive is a platform that:

• Connects aspiring drivers with registered driving schools
• Facilitates digital attendance tracking via QR codes
• Records driving practice routes using GPS technology
• Provides vehicle management tools (My Garage)
• Enables driving schools to manage students and generate leads

We act as an intermediary platform and are not responsible for the quality of driving instruction provided by third-party driving schools.

3. User Eligibility

• You must be at least 16 years old to use this App
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account
• One account per mobile number is permitted

4. User Accounts

4.1 Account Types

• Learner Account: For individuals seeking driving education
• School Owner Account: For registered driving school businesses

4.2 Account Security

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• We may suspend accounts suspected of security breaches

5. Acceptable Use Policy

5.1 You Agree NOT To:

• Provide false information or impersonate others
• Use the App for any illegal purpose
• Attempt to gain unauthorized access to other accounts
• Interfere with the App's operation or security
• Use automated systems to access the App without permission
• Harass, abuse, or harm other users or driving schools
• Post false reviews or misleading information

5.2 For Driving School Owners

• You must be a legally registered business to list on ApexDrive
• Information about your school (fees, services) must be accurate
• You are solely responsible for the quality of instruction provided
• You agree to pay applicable platform fees as per your subscription

6. Location Services

By enabling location permissions, you agree that:

• GPS tracking is used only during active attendance sessions
• Route data is stored to create your practice history
• Location data is shared with your enrolled driving school
• You can disable location services at any time via device settings

7. Payments and Fees

7.1 For Learners

The App is free to use for learners. Any fees for driving lessons are paid directly to your chosen driving school.

7.2 For Driving Schools

• Lead generation may incur per-lead charges
• Subscription plans are available for premium features
• All fees are non-refundable unless otherwise stated
• We reserve the right to modify pricing with 30 days' notice

8. Intellectual Property

• The App, its content, and trademarks are owned by Shivonix Technologies
• You may not copy, modify, or distribute any part of the App
• User-generated content (reviews, photos) remains your property but grants us a license to display it

9. Disclaimers

9.1 No Warranty

The App is provided "AS IS" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Accuracy of information provided by driving schools
• Quality of driving instruction from third-party schools

9.2 Driving School Relationship

We are NOT responsible for:

• Actions, omissions, or negligence of driving schools
• Disputes between learners and driving schools
• Injuries, accidents, or damages during driving lessons

10. Limitation of Liability

To the maximum extent permitted by law, Shivonix Technologies shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages exceeding the amount you paid us in the past 12 months

11. Termination

• You may delete your account at any time via the App settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App ceases immediately
• Data retention post-termination is governed by our Privacy Policy

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra, India.

13. Changes to Terms

We may update these Terms periodically. Material changes will be notified via:

• In-app notification
• Updated date on this page

Continued use after changes constitutes acceptance of the new Terms.
